With this judgment, dsm-firmenich has successfully defended the patent against a second invalidation challenge brought by Haineng before the first instance court.
dsm-firmenich has secured a favorable ruling from the Beijing Intellectual Property Court. The decision upheld the China National Intellectual Property Administration’s (CNIPA) recognition of its patent on swine compound premixes containing 25‑hydroxyvitamin D3.
Shandong Haineng Bioengineering Co Ltd (Haineng) appealed this ruling.
dsm-firmenich is a pioneer and a leading global manufacturer of 25-hydroxyvitamin D3, the major circulating form of vitamin D. Marketed under the Hy‑D brand, it is widely used in animal feed and other applications.
With this judgment, dsm-firmenich has successfully defended the patent against a second invalidation challenge brought by Haineng.
“We are pleased with the consistent recognition of our innovations by the court and CNIPA. It is an example of the strength of our robust patent portfolio in the 25-hydroxyvitamin D3 area,” said Fidelis Fru, Head of Business Development, Animal Nutrition & Health at dsm-firmenich.
“We have a comprehensive patent portfolio around the world, and this protects our continued investments in innovation and our position as a technology leader in 25-hydroxyvitamin D3.”
Dr Fru added, “We look forward to continuing to provide our customers with the highest-quality products and services. In the meantime, we proactively monitor third-party activities for potential infringement and acts where necessary to protect against any unauthorized use of our patented technology.”
